How classification options are compared
Where different codes are proposed, start with the significant distinction between the headings considered and the properties of the specific goods. A list of superficially similar codes without an explanation of characteristics does not show why one option was chosen and another excluded.
For each option, select the relevant nomenclature wording, notes and explanations. Compare them with established characteristics: material, composition, function, construction, degree of processing and actual presentation. The commercial name is used alongside this information rather than in its place.
- Which property distinguishes the options discussed.
- Which document or examination result substantiates that property.
- Whether the document concerns the specific model and variant of the goods.
- Which significant information remains missing or contradictory.
- How these gaps limit substantiation of the selected option.
If the proposed code is already stated in a declaration, decision or report, attach the complete document with the commodity description. Establish which characteristics supported the original reasoning. A code's presence in another participant's document does not reveal the grounds for it.
A substantive result allows the reasoning from substantiated properties to a classification option to be followed. Where a key characteristic is unestablished, this is recorded separately. An additional manufacturer's description, inspection or examination of a particular property may be needed, but its necessity depends on the specific gap identified.
